Last Revised: 19 June 2025
These Terms and Conditions (“Terms”) govern your access to and use of the online marketplace operated by Anglers’ Cove Ltd. (“Anglers’ Cove,” “we,” “us,” or “our”), a company incorporated in England and Wales with a registered office at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ. The marketplace includes the website at cove-tp.com (the “Website”) and all related applications, services, and content (collectively, the “Services”). By accessing or using the Services, whether as a Buyer, a Seller, or otherwise, you agree to be bound by these Terms in full. If you do not agree with any provision in these Terms, you must immediately cease all use of the Services.
Consumer Rights Notice
Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or other applicable UK consumer protection laws.

1. Our Services
We operate a marketplace that allows Buyers to purchase fishing-related products from Sellers. The Services are intended to be used in compliance with all applicable laws. We do not warrant that our Services comply with any industry-specific regulations (such as HIPAA, FISMA, or GLBA). If any User’s planned activities are subject to such regulations, that User must not use the Services. Anglers’ Cove makes no representation or warranty that any content or listings on the Services are permitted in all jurisdictions; you are responsible for ensuring that your use of the Services complies with local law where you are located.
2. Intellectual Property and Licenses
2.1 Our Intellectual Property
All right, title and interest in the Services and their contents – including, without limitation, all text, graphics, logos, images, software, and other materials (the “Content”) – are owned by or licensed to Anglers’ Cove and are protected by copyright, trademark and other intellectual property laws in the UK and worldwide. The word marks and logos of Anglers’ Cove and other trademarks, service marks, and trade dress featured on the Services are the property of Anglers’ Cove or other rights-holders.
Subject to these Terms, we grant you a limited, revocable, non-exclusive license to access and use the Services and to view and download Content solely for your personal, non-commercial use or internal business purposes (for example, a Buyer purchasing products or a Seller managing listings). You may print or download pages and Content for these purposes only, and only provided you keep all copyright and other proprietary notices intact. Any other use of the Content – including modification, distribution, republication, or commercial exploitation – requires our prior written consent. All rights not expressly granted herein are reserved by Anglers’ Cove.
2.2 Submissions and Feedback
“Submissions” refers to any ideas, suggestions, proposals, feedback, or other materials you voluntarily provide to Anglers’ Cove, whether through the Services, by email, surveys, or other means of communication, that are not intended as public Contributions under Section 11. This includes, but is not limited to, feedback on features, ideas for improvements, bug reports, design suggestions, or business concepts.
By submitting any Submissions, you automatically grant (and you represent and warrant that you have the right to grant) to Anglers’ Cove a worldwide, perpetual, irrevocable, royalty-free, fully-paid, transferable, and sublicensable licence to use, reproduce, modify, distribute, publicly perform, publicly display, and otherwise exploit such Submissions for any lawful purpose, including commercial and product development purposes, without restriction or obligation to you.
You acknowledge and agree that:
(a) Anglers’ Cove has no obligation to treat Submissions as confidential or proprietary;
(b) you will not receive any compensation, recognition, or attribution for Submissions; and
(c) you waive any moral rights or similar claims in relation to the use of your Submissions, to the fullest extent permitted by law.
3. User Registration and Accounts
Certain features of the Services (such as listing products for sale or making purchases) require you to register for a user account. You agree to provide accurate, current, and complete information when you register and to update your account information as needed to keep it accurate. You are responsible for maintaining the confidentiality of your account login credentials and are fully responsible for all activities that occur under your account. You must immediately notify us of any unauthorised use of your account or any other breach of security. Anglers’ Cove may suspend or close any account that Anglers’ Cove, in its sole discretion, considers inappropriate (for example, if the username is obscene or infringing).
Anglers’ Cove reserves the right to remove, reclaim, or change a username you select if, in Anglers’ Cove’s sole judgment, it violates these Terms or is otherwise objectionable.
- User Representations
By using the Services, you represent and warrant that:
(a) all registration information and any other information you provide to us is true, accurate, current, and complete;
(b) you have the legal authority to use the Services and to enter into and comply with these Terms;
(c) you are at least 18 years old and not considered a minor under the laws of your jurisdiction;
(d) you will not access the Services through automated means (such as bots, spiders, or scrapers) except to the extent expressly permitted by these Terms;
(e) you will not use the Services for any unlawful or unauthorised purpose, and will use them only in accordance with these Terms and applicable laws and regulations;
(f) you are not listed on any trade-embargo, economic-sanctions, or watch lists maintained by the UK, EU, United States, or any other relevant jurisdiction, and you will not use the Services to transact in any goods, technology, or software in violation of export-control or sanctions laws;
(g) you will not use the Services to facilitate money-laundering, terrorist financing, or other illicit financial activity, and all funds you transact through the Services originate from lawful sources;
(h) if you list or sell physical goods, you warrant that those goods comply with all applicable UK and EU product-safety, labelling, and certification requirements (including CE or UKCA marking where required) and that you will provide any necessary safety documentation upon request;
(i) if you are responsible for collection of VAT or other sales taxes, you will register for, collect, remit, and report such taxes in accordance with applicable law, and Buyers will be responsible for any import duties, customs fees, or other local taxes on shipped goods;
(j) for all physical-goods transactions, title and risk of loss pass from Seller to Buyer (and any carrier) upon delivery to the carrier at the Seller’s dispatch location;
(k) if you process or collect personal data of other users through the Services, you will comply with the UK GDPR, applicable data-protection laws, and our Privacy Policy; and
(l) you will not induce, facilitate, or otherwise enter into any off-platform transaction for the same goods or designs sold here for the purpose of evading our fees or commissions.
If we discover that any of the information you submit is false, inaccurate, outdated, or incomplete, or that you breach any of the above representations, we may refuse or suspend your access to the Services without liability or notice.
5. Product Listings and Descriptions
Sellers control the content of their listings. However, we strive to present product information (including colors, features, and specifications) as accurately as possible. Anglers’ Cove does not warrant the accuracy or completeness of any listing. Because many products (e.g. fishing lures) are handmade or custom-made, actual products may vary in appearance from listing images. Your display device may also not render colors precisely. Accordingly, you agree that all products are provided “AS IS,” and Anglers’ Cove makes no guarantee regarding the accuracy, completeness, or reliability of any product description or image.
All products are subject to availability. Anglers’ Cove or Sellers may discontinue any product or listing at any time without notice, and prices may change without notice. We reserve the right to adjust prices or correct pricing errors at any time, even after you have placed an order.
6. Purchases, Pricing, and Payments
When you make a purchase through the Services, you agree to pay all charges (including any taxes and shipping fees) at the prices in effect at the time of purchase. We may add sales tax or VAT as required by law. Anglers’ Cove accepts the following payment methods (subject to change): Visa, MasterCard, American Express, and any other methods we may list on the Website from time to time.
You must provide current, complete and accurate payment information and authorize us to charge the full purchase price—including any applicable taxes, duties and shipping fees—to your chosen payment method. All payments will be settled in U.S. dollars (USD). Where prices are displayed in any other currency for your convenience, the final charge will be converted to USD at the exchange rate applied by our payment processor on the date of your transaction. You remain responsible for any foreign-exchange or conversion fees imposed by your bank or payment provider.
Price Corrections and Order Limitations: We reserve the right to refuse or cancel any order for any reason. If an item is mispriced or the description contains an error, we may correct it and refund any difference or cancel the order. We may also impose quantity limits per order, per customer, or per household. Orders that, in our sole judgment, appear to be placed by dealers, resellers, or for other commercial purposes may be limited or cancelled.
Payment Processing: Payments on the platform are processed through a third-party service (such as Stripe Connect). By making a purchase, you agree to the third-party’s terms of service. Anglers’ Cove does not store or process your payment card details and is not responsible for payment errors or disputes. If you have an issue with a payment or refund, please contact the payment processor (for example, Stripe) in accordance with their terms.
7. Subscriptions
Anglers’ Cove may offer subscription services (for example, access to premium content or recurring product shipments). Subscription terms are as follows:
- 7.1 Subscription Types: “One-Off” subscriptions provide a single access period that expires at the end of the term with no further charges. “Recurring” subscriptions automatically renew at the end of each billing cycle until cancelled.
- 7.2 Billing and Renewal: For Recurring subscriptions, you authorise us to charge your chosen payment method on a recurring basis without further notice until you cancel. One-Off subscriptions are charged only once and do not renew.
- 7.3 Cancellation: You may cancel a Recurring subscription at any time through your account settings; cancellation will take effect at the end of the current billing period. One-Off subscriptions cannot be cancelled after purchase (they simply expire).
- 7.4 UK Consumer Cancellation Rights: If you are a consumer (a Buyer) in the UK or another jurisdiction with similar consumer-protection laws, you have a right to cancel a service contract within 14 days of the contract date, in accordance with the Consumer Contracts Regulations 2013. This right generally applies to Recurring subscriptions unless the performance of the service was fully completed with your prior express consent before the cancellation period ended. (If you agreed to immediate performance and to waive the 14-day withdrawal right, you are not entitled to cancel after that point.)
- 7.5 Digital Content: If the subscription grants you access to digital content (for example, downloadable 3D design files) and you begin accessing or downloading that content, your right to cancel the subscription for that period ends immediately upon download (i.e. the contract is treated as fully performed). In practical terms, once you download any file or begin consuming digital content, you forfeit any refund or cancellation right for that billing period under the cancellation regulations.
Anglers’ Cove will facilitate cancellations in compliance with applicable law. For assistance with subscriptions, you may contact us at [email protected].
8. Returns and Refunds
8.1 Physical Goods
For purchases of physical products from Sellers, UK law generally gives Buyers the right to cancel an order within 14 days of receipt and return the item (assuming the goods are returned in the required condition). Sellers are required to provide a refund policy in accordance with UK consumer law, and to display or link to that policy on their product listings. Buyers must follow the Seller’s specified return process in order to obtain a refund or exchange.
Anglers’ Cove may, at our discretion, facilitate the return and refund process between Buyers and Sellers. However, we are not obligated to enforce any Seller’s policy beyond what UK law requires. If a product does not match its description or is defective, you should follow the Seller’s returns procedure; if the Seller fails to respond, you may contact us for assistance, and we will make reasonable efforts to help within our capabilities.
8.2 Digital Goods
All purchases of digital products (for example, downloadable STL files) are final. By accessing or downloading any digital file, you acknowledge and agree that, to the fullest extent permitted by applicable law (including the Consumer Contracts Regulations 2013), you waive any right to cancel, return, repair or replacement with respect to that digital content. Nothing in these Terms prevents you from exercising any statutory right that by law cannot be waived.
9. Software License
Any software made available on or with the Services (for example, a program for managing product listings) may be subject to a separate End User License Agreement (EULA). If no specific EULA is provided, then Anglers’ Cove grants you a limited, revocable, non-exclusive license to use such software solely in connection with the Services. The software is provided “AS IS” without warranty; you assume all risk in its use. You may not copy, distribute, modify, decompile, or otherwise reverse-engineer any software provided with the Services except to the extent allowed by law or explicitly authorised by Anglers’ Cove.
10. Prohibited Conduct
You agree not to use the Services for any purpose other than those explicitly permitted by these Terms. Unauthorised commercial use is prohibited. In particular, you shall not:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
- Access or use the Services in any way that bypasses security restrictions or technical limitations (e.g. hacking, tampering, or reverse-engineering).
- Use spiders, bots, scrapers, automated scripts, or data-mining tools (other than conventional search engine indexing) to collect content or any other information from the Services.
- Impersonate any person or entity, including using another user’s account or login.
- Use automated or manual means to extract data (e.g. web scraping or harvesting) from the Services to compile databases or directories, without our prior written consent.
- Interfere with or disrupt the servers or networks used by the Services, or violate any requirements, procedures, policies or regulations of networks connected to the Services.
- Remove, obscure or alter any copyright, trademark, or other proprietary notices on the Services.
- Upload or transmit any unsolicited or bulk communications (spam), advertising or promotional material not expressly authorised, or any other content intended to solicit or sell goods or services (such as pyramid schemes or chain letters).
- Upload or distribute viruses, malware, spyware, or any malicious code. You must not embed tracking beacons or similar passive data-collection tools into content without clear disclosure and consent.
- Harass, abuse, threaten, stalk, or otherwise violate the legal rights (such as rights of privacy and publicity) of others. This includes Users, our personnel, or any third parties.
- Use the Services to store or transmit material that infringes on any intellectual property or other proprietary right of any person.
- Use the Services in any way that violates our or another person’s privacy rights. Collecting personal data about other users of the Services by any automated means without their express permission is prohibited.
- Use the Services to engage in any business that competes with Anglers’ Cove, or otherwise exploit the Services for commercial gain other than selling products through the marketplace as permitted by us. (For example, you may not use our platform to sell unrelated products without our approval, or to recruit sellers to a competing platform.)
Anglers’ Cove reserves the right, in our sole discretion, to determine whether any use of the Services is prohibited. Any violation of these rules may result in suspension or termination of your account and legal action.
11. User-Generated Content
11.1 Contributions and Licensing
“Contributions” refers to any content or material that you submit through the Services, including product listings, reviews, comments, images, videos, designs(excluding any Digital Designs), or other materials. Unless we indicate otherwise, all Contributions are non-confidential and non-proprietary. By submitting any Contribution to the Services, you grant Anglers’ Cove and its affiliates a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully-paid license (with the right to sublicense) to host, use, copy, reproduce, distribute, publicly display, publicly perform, adapt, modify, translate, create derivative works of, and otherwise exploit such Contributions, in whole or in part, in any media now known or later developed, for any purpose (including commercial purposes) consistent with the Services. This includes the right to use your name, company name, trademarks, or logos in connection with your Contributions. You also waive any moral or similar rights in your Contributions to the fullest extent permitted by law.
You retain ownership of any intellectual property rights you hold in your Contributions. Anglers’ Cove does not claim any ownership of your Contributions beyond the license granted herein. However, you acknowledge and agree that Anglers’ Cove may freely use and distribute your Contributions under the license above. You agree to indemnify and hold Anglers’ Cove harmless for any claims arising from content you submit.
Anglers’ Cove reserves the right, but is not obligated, to edit, refuse, move, or delete any Contributions for any reason, including if the Contributions violate these Terms or any applicable policies.
11.2 Content Standards and Warranties
By submitting Contributions, you represent and warrant that:
- Ownership and Rights: You own or have all rights, licenses, consents and permissions necessary to submit the content and grant the above license. If any person appears in your content, you have obtained their permission to use their name, likeness, and voice. If your Contribution includes branded or trademarked goods, you further represent and warrant that such products are authentic, lawfully sourced, and not counterfeit. You agree to provide documentation of authenticity or lawful sourcing upon request.
- Non-Infringement: Your Contributions do not infringe or violate any third party’s intellectual property rights or other proprietary rights (such as copyrights, trademarks, or privacy rights).
- Accuracy and Truthfulness: Your Contributions are truthful, accurate, and not misleading. Any product descriptions, specifications, or pricing information in your content accurately reflect the actual item.
- Legality and Decency: Your Contributions do not violate any law or regulation and do not contain defamatory, obscene, lewd, violent, discriminatory, hateful, harassing, or illegal content. Your Contributions do not include unauthorised advertising, spam, or other promotional materials not permitted by us.
- Technical Integrity: Your Contributions do not include viruses or any malicious code, and do not attempt to interfere with the operation of the Services or bypass any technical safeguards.
Any Contributions that violate these standards may be removed, and offending accounts may be suspended or terminated.
11.3 Reviews and Ratings
If the Services allow you to post reviews or ratings, you agree to the following guidelines:
- Your review must be based on your genuine and personal experience with the product or service.
- You must not post defamatory, obscene, abusive, or discriminatory content.
- You must not post content that violates any law, such as encouraging criminal activity.
- You must not post legal conclusions or treat reviews as legal advice.
- You must not post fake reviews, or organise bulk review campaigns for or against any person or entity.
- You must not review a competitor’s product if you have a vested interest (unless you disclose it).
- Your review must be truthful and accurate to the best of your knowledge.
By posting a review, you grant Anglers’ Cove the same license (as above) to use, reproduce, and publish your review. Reviews are not endorsed by Anglers’ Cove; they are the opinions of the Users. We are not responsible for any claims or disputes arising from reviews or ratings.
11.4 Vendor-Provided Digital Designs
Sellers may offer digital design files (for example, 3D model files in STL or similar format) for sale or download. By uploading any such design file to the Services, you represent and warrant that you have full legal right to do so and to grant the rights below. You agree to grant Anglers’ Cove and end users a perpetual, worldwide, royalty-free license to access, download, and use the design file. Each design file must clearly specify what end-users are permitted to do with it (e.g. whether they may print it, use it for personal or commercial purposes, or resell physical prints). Any usage license you communicate in the product listing is binding and cannot be revoked after users have downloaded the file.
You may not retroactively restrict or alter any usage rights you have already granted to users via the Services. Any attempt to rescind rights after a transaction or download is a material breach of these Terms and will result in immediate suspension or termination of your selling privileges. Anglers’ Cove reserves the right to remove any design file that appears to infringe third-party rights or that fails to comply with these rules.
12. Platform-Provided Digital Designs
12.1 Definition.
Certain subscription plans, memberships, or promotional offers may include access to digital design files provided directly by Anglers’ Cove—such as STL files or other 3D model formats (“Platform Designs”). These files are the exclusive intellectual property of Anglers’ Cove Ltd or its licensors and are not considered User Contributions under these Terms.
12.2 Licence Grant.
Subject to your ongoing compliance with these Terms and any applicable subscription conditions, Anglers’ Cove grants you a limited, revocable, non-transferable, non-sublicensable licence to:
- download the Platform Design; and
- manufacture physical items solely for:
(a) personal, non-commercial use, or
(b) commercial sale exclusively through the Services.
This licence applies to both the original Platform Design and to any modified, adapted, altered, or derivative version thereof.
No other rights are granted unless expressly authorised in writing by Anglers’ Cove Ltd through a separate licence agreement.
12.3 Prohibited Uses.
Unless expressly permitted in writing by Anglers’ Cove, you may not, directly or indirectly:
- sell, distribute, share, publish, or otherwise make available the Platform Design file in digital form, whether in its original or modified state;
- sell or offer for sale physical items made from the file through any platform, website, channel, or service other than the Services;
- sublicense, rent, lease, or otherwise transfer the file or any derivative version to third parties;
- use the file or any derivative version in any way that infringes third-party intellectual property rights, violates applicable law, or circumvents platform restrictions.
These restrictions apply regardless of any modification, transformation, or derivative use, unless explicitly overridden by a written licence issued by Anglers’ Cove Ltd.
12.4 Enforcement.
Any unauthorised use, reproduction, or distribution of Platform Designs constitutes a material breach of these Terms. Anglers’ Cove reserves the right to suspend or terminate your account without notice, and to pursue all appropriate legal remedies, including injunctive relief and claims for damages, infringement, or misappropriation.
12.5 Reservation of Rights.
All rights not expressly granted in this Section are fully reserved by Anglers’ Cove Ltd. The licence described in Section 12.2 shall automatically terminate upon your breach of these Terms, your violation of applicable subscription terms, or cancellation or expiration of the relevant subscription.
13. Social Media and Third-Party Account Connections
The Services may allow you to link your third-party social media or networking accounts (such as Facebook, Google, or Twitter). By linking, you authorise Anglers’ Cove to access and store certain information from those accounts as permitted by your account privacy settings. This may include your public profile and list of friends or followers, which we may use to enhance your experience (for example, by finding friends on the platform). If you choose to disconnect a linked account, Anglers’ Cove will stop accessing new data from it, but previously imported data may remain in your account (except where deletion is requested and possible).
We make no guarantees about the content or availability of any third-party site. Your use of third-party services is subject to the terms of those services. Anglers’ Cove does not endorse or assume responsibility for any content, products, or services offered by third parties. If you permit, we may access your device’s contact list or email address book solely to let you find other registered users to connect with; any import of contacts is done only with your consent and for this purpose.
14. Operation and Management of the Services
Anglers’ Cove reserves the right, at our discretion, to:
- Monitor the Services for compliance with these Terms.
- Initiate legal proceedings or report misconduct to law enforcement against anyone who violates the law or these Terms.
- Refuse, restrict, suspend, or disable access to the Services (or any portion of them), including removing any Contributions or files, if we believe a user is violating these Terms or overloading the system.
- Remove or delete any content that is unduly large or places an unreasonable burden on our infrastructure.
- Enforce any security or technical measures we deem necessary to protect the Services and our rights.
- Upon reasonable written notice, any Seller must promptly furnish Anglers’ Cove with documentation—such as product-safety certifications, export-control licence, VAT registration, or other proof—sufficient to verify compliance with any representation or warranty made under these Terms. Failure to provide such documentation within ten (10) business days will constitute a material breach and may result in suspension or termination of your selling privileges.
We are under no obligation to backup or maintain any user data or Contributions beyond what is required by law.
15. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy at https://cove-tp.com/privacy-policy/, which is incorporated by reference into these Terms and is legally binding on you. By using the Services, you agree to the terms of the Privacy Policy.
The Services are primarily hosted and operated in the UK (and possibly the US). If you access or use the Services from a country outside the UK or the US, you consent to the transfer of your personal data to the UK, the US, and other countries as described in our Privacy Policy. We implement appropriate safeguards (such as Standard Contractual Clauses and the UK data protection addendum) to protect your personal data in accordance with applicable law (including UK GDPR and, if applicable, EU GDPR). Continued use of the Services constitutes your consent to these transfers and practices.
16. Copyright Infringement
We respect the intellectual property rights of others. If you believe that any content on the Services infringes your copyright or other protected right, please notify us promptly by following the procedure set out in our DMCA Policy (cove-tp.com/dmca). Upon receiving a valid notice, we will take actions required by law, which may include removing or disabling access to the allegedly infringing material. We reserve the right to terminate accounts of repeat infringers. Filing a false infringement claim may result in legal liability for the claimant.
17. Term and Termination
These Terms are effective until terminated. Anglers’ Cove may suspend or terminate your account and access to the Services at any time, without notice or liability, for any reason (including violation of these Terms or applicable law). We may remove any content you have posted. Upon termination, all licenses you have granted to us (such as in Section 11) survive, as do all disclaimers, indemnities, and limitations of liability. If your account is terminated, you may not create another account without our permission. We also reserve the right to pursue any other remedies available to us (for example, injunctive relief or damages) in the event of a breach.
18. Changes and Interruptions to the Services
Anglers’ Cove may modify, suspend or discontinue any aspect of the Services at any time, with or without notice and without liability. This includes adding or removing features, changing content or functionality, and altering the pricing or availability of any product or subscription. We do not guarantee that the Services will be uninterrupted or error-free. Downtime may occur for scheduled maintenance or emergency repairs. You agree that Anglers’ Cove will not be liable for any damages or losses caused by any such modifications or interruptions.
Nothing in these Terms obligates us to provide any updates, upgrades, or support for the Services.
19. Governing Law and Jurisdiction
These Terms (including any disputes arising out of or relating to them) are governed by the laws of England and Wales, without regard to conflict of law principles, and excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer residing in an EU member state, nothing in these Terms will prejudice the mandatory consumer-protection rights provided by the laws of your country of residence.
You and Anglers’ Cove each submit to the non-exclusive jurisdiction of the courts of London, England and Wales for any legal proceedings arising out of these Terms. If you are an EU consumer, you may also bring proceedings in the courts of your member state to enforce your statutory consumer rights.
20. Dispute Resolution (Arbitration)
20.1 Negotiation. In the event of any dispute or claim arising from these Terms or the Services (a “Dispute”), the parties will first attempt to resolve it informally by good-faith discussions. Either party may initiate this process by written notice to the other. The parties will cooperate in good faith to resolve the Dispute within thirty (30) days of such notice before commencing any formal legal action.
20.2 Arbitration. If the Dispute is not resolved by negotiation, it shall be finally settled by binding arbitration under the rules of the European Court of Arbitration (ECA). The arbitration will be conducted in London, England, in the English language, and governed by English law. The arbitrator’s decision will be final and binding. The parties expressly waive any right to trial by jury or to participate in a class or representative action.
20.3 Exceptions. Notwithstanding the foregoing, any of the following claims may be brought in court without first going to arbitration: (a) claims to enforce or defend a party’s intellectual property rights; (b) claims involving allegations of theft, piracy, invasion of privacy or unauthorised use; (c) requests for injunctions or other equitable relief.
20.4 Limitation of Actions. Any claim, dispute or cause of action arising out of or relating to these Terms or the Services must be filed within one (1) year after the cause of action accrues; otherwise it is permanently barred.
If any portion of this arbitration section is deemed unenforceable, the remaining provisions will remain in force, and the Dispute will be resolved in court in accordance with Section 19 above.
21. Corrections and Updates
Anglers’ Cove strives for accuracy in all listings and content, but errors may occur (for example, typographical errors in descriptions, pricing, or availability). We reserve the right to correct any mistakes and to change or update content on the Services at any time without prior notice. We assume no liability for errors or omissions or for updating content.
22. Disclaimer of Warranties
YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. The Services and all content, products and services provided through them are offered “AS IS” and “AS AVAILABLE,” without any warranty or condition, express, implied or statutory. To the fullest extent permissible under law, Anglers’ Cove disclaims all warranties of any kind, including, but not limited to:
- Merchantability and Fitness: No warranty of merchantability, fitness for a particular purpose, or quality is made with respect to the Services or any products sold.
- Accuracy: No warranty that any content on the Services or any linked site will be accurate, complete, reliable or up to date.
- Performance: No warranty that the Services will be uninterrupted, secure, or free of errors, bugs or malware.
- Availability: No warranty that any defect will be corrected or that the Services will always be available.
- Security: No warranty that unauthorised access or data loss will not occur.
Anglers’ Cove does not control and is not responsible for any content posted by users or any third-party websites linked to the Services. We do not endorse any opinions or statements made by users.
Use Caution: You use the Services at your own discretion. You agree that Anglers’ Cove is not responsible for any personal injury, loss or damage of any kind that results from accessing or using the Services or any third-party products sold or advertised on or off the platform.
23. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Anglers’ Cove (AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY) ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL ANGLERS’ COVE’S AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS—INCLUDING CLAIMS BASED ON NEGLIGENCE, BREACH OF CONTRACT, TORT, OR OTHERWISE—ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE TOTAL AMOUNT PAID BY YOU TO ANGLERS’ COVE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS WILL EXCLUDE OR LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY ANGLERS’ COVE’S NEGLIGENCE, OR FOR FRAUD OR OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
Marketplace Disclaimer
Anglers’ Cove provides the platform but is not a party to transactions between Buyers and Sellers. We do not manufacture or inspect the products sold by Sellers. Seller responsibility: Sellers are solely responsible for listing products that comply with all applicable safety standards and laws, and for accurately describing their products. Buyer acknowledgment: Buyers understand that Anglers’ Cove is not involved in the actual sales transaction; any purchase you make is solely between you and the Seller. We may provide communication tools or a payment interface, but we do not take title to any items sold. If a transaction does not proceed as planned, or if the product is damaged, defective or non-conforming, you should resolve the issue with the Seller. We may offer to facilitate returns or refunds, but we are not required to do so unless the law mandates.
Payment Liability
As noted above, payments are handled by Stripe Connect (or a similar provider). Anglers’ Cove does not process or store your payment card details and is not responsible for any disputes, delays, or errors that occur during payment processing.
